Welcome to ThankRank.
These Terms of Service (“Terms”) govern your access to and use of the ThankRank website, application, software, and related services.
ThankRank is operated by an individual in India under the ThankRank brand. References to “ThankRank,” “we,” “us,” and “our” mean the individual operating the service under this brand. ThankRank is not represented as an incorporated company.
By accessing our website, creating an account, purchasing a subscription, or using our services, you agree to these Terms. If you do not agree, you must not use the services.
If you use ThankRank on behalf of a business, agency, or other organization, you confirm that you are authorized to accept these Terms on its behalf.
2. About ThankRank
ThankRank provides software intended to help businesses manage their online reputation, collect and manage customer feedback, monitor reviews, improve business visibility, and use AI-assisted tools and analytics.
Depending on your plan, configuration, and feature availability, the services may include:
Review management and monitoring.
Review collection campaigns and feedback forms.
Review response management and AI-assisted reply suggestions.
Business visibility and local search ranking tools.
AI visibility tracking and insights.
Analytics, reporting, and performance monitoring.
Review widgets, QR codes, and related promotional tools.
Integrations with supported third-party platforms.
Other features introduced or made available from time to time.
Features may differ by subscription plan, location, integration, and technical availability. We may introduce, modify, suspend, or discontinue features subject to these Terms and applicable law.
3. Eligibility and Business Accounts
ThankRank is a business-oriented service. You must be at least 18 years old, or the applicable age of legal majority if higher, and legally capable of entering into a binding agreement to use the service.
When creating or maintaining an account, you agree to:
Provide accurate and current registration and business information.
Keep your login credentials confidential.
Take reasonable steps to protect your account.
Notify us promptly if you suspect unauthorized access.
Ensure that people using your account are authorized to do so.
Keep your account information updated.
Use the service in compliance with applicable laws and these Terms.
You are responsible for activities conducted through your account, except to the extent that applicable law provides otherwise or the activity results from circumstances for which you are not legally responsible.
We may request information reasonably necessary to verify an account, investigate suspected misuse, or comply with legal obligations.
4. Subscriptions, Plans, and Billing
ThankRank may offer free plans, paid subscriptions, and other service options.
The features, usage limits, prices, billing frequency, and other conditions of each plan will be presented on the relevant pricing or checkout page.
4.1 Paid Subscriptions
When you purchase a paid plan, you authorize the applicable payment provider to process the charges associated with your selected subscription.
You agree to pay the fees and applicable taxes disclosed during checkout. Unless otherwise stated at purchase, subscriptions renew automatically at the end of each billing period until canceled.
You are responsible for maintaining valid payment information and ensuring that subscription charges can be processed.
4.2 Subscription Renewals
Your subscription will renew according to the billing frequency selected when you subscribe, unless you cancel it before the next renewal.
The applicable subscription price and billing terms will be displayed before you complete your purchase. Any change to subscription pricing will be communicated as required by applicable law. A price change will not retroactively change fees already paid for a completed billing period.
4.3 Failed Payments
If a subscription payment fails, we may notify you and request updated payment information.
Where permitted by applicable law and the applicable subscription terms, we may retry the payment, restrict paid features, suspend access to the paid plan, or cancel the subscription if payment remains outstanding.
We will not use this section to exclude rights that cannot lawfully be limited.
4.4 Taxes
You are responsible for taxes applicable to your purchase, except taxes imposed on our income, where applicable law allocates responsibility differently.
Prices and taxes will be presented during checkout where required.
5. Cancellation and Refunds
5.1 Canceling a Subscription
You may cancel your paid subscription at any time through the available account or subscription controls, or by contacting us if self-service cancellation is unavailable.
When you cancel:
Your cancellation will stop the subscription from automatically renewing, subject to the applicable billing and cancellation process.
Your paid plan will remain active until the end of your current paid billing period.
You may continue to use the paid features included in your plan until that billing period ends, provided your account remains in good standing.
You will not be charged for a subsequent renewal after cancellation has taken effect.
You will not ordinarily receive a refund for the unused portion of the current billing period, except where required by applicable law or expressly stated otherwise by ThankRank.
Canceling your subscription does not automatically delete your ThankRank account. If you want your account and eligible personal information deleted, you must submit a separate account deletion request where required.
5.2 Refund Policy
Except where required by applicable law or expressly stated otherwise by ThankRank, subscription fees are non-refundable once a billing period has started.
We do not ordinarily provide refunds or credits for:
Partially used billing periods.
Unused time remaining after cancellation.
Failure to use the service or particular features.
Changes in your business needs or preferences.
Features you choose not to use.
Account restrictions or termination resulting from a violation of these Terms, to the extent permitted by law.
Nothing in these Terms excludes a refund, cancellation right, or other remedy that must be provided under applicable law.

6. Acceptable Use
You agree to use ThankRank lawfully, responsibly, and only for authorized purposes.
You must not:
Use the service to create, purchase, submit, or facilitate fake reviews, ratings, testimonials, or other misleading endorsements.
Manipulate reviews, ratings, or reputation metrics through fraudulent, deceptive, or prohibited practices.
Use review campaigns to mislead customers or improperly influence the authenticity of their feedback.
Publish or distribute unlawful, defamatory, threatening, harassing, discriminatory, or otherwise prohibited content.
Violate another person’s privacy, intellectual property, publicity, or other legal rights.
Access accounts, data, systems, or integrations without authorization.
Attempt to bypass usage limits, authentication controls, security measures, or subscription restrictions.
Interfere with the service, introduce malicious code, or conduct unauthorized security testing.
Reverse engineer, decompile, or attempt to extract source code from the service except where applicable law expressly permits it.
Copy, resell, sublicense, or commercially exploit the service except as authorized by your plan or a separate written agreement.
Use automated means to access the service in a way that violates these Terms or imposes unreasonable load on our systems.
Use the service in violation of the terms, policies, or technical restrictions of a connected platform.
Use ThankRank to send unlawful spam or communications without the permissions or consent required by law.
We may investigate suspected violations and take proportionate action, including removing content, restricting features, suspending an account, or terminating access where justified and permitted by applicable law.
7. Reviews and Customer Feedback
ThankRank provides tools intended to help businesses request, monitor, display, and manage customer feedback.
You are responsible for how you use those tools and for complying with applicable consumer protection, advertising, privacy, and platform rules.
You must not use ThankRank to:
Fabricate customer experiences or reviews.
Impersonate customers or submit reviews on their behalf without proper authorization.
Offer prohibited incentives in exchange for positive reviews.
Suppress, conceal, or selectively manipulate negative feedback in violation of applicable law or platform policies.
Misrepresent review authenticity, customer satisfaction, or business ratings.
Publish customer information without an appropriate legal basis or authorization.
Review platforms may remove reviews, change their policies, restrict access, or suspend integrations independently of ThankRank. We do not guarantee that any particular review will be published, remain available, or result in a higher rating or ranking.
8. Third-Party Platforms and Integrations
ThankRank may allow you to connect or use third-party services, including business profile platforms, review platforms, communication services, and other supported integrations.
Your use of those services may be subject to separate terms, privacy notices, permissions, and usage restrictions imposed by the relevant provider.
You are responsible for:
Ensuring you have authority to connect each account.
Granting only the permissions necessary for your intended use.
Maintaining access to connected accounts.
Complying with the applicable third-party terms and policies.
Reviewing and revoking permissions when appropriate.
We do not control independent third-party services and are not responsible for their availability, policy changes, decisions, or actions, except where applicable law provides otherwise.
An integration may become unavailable or have its functionality restricted because of changes made by a third party. We do not guarantee uninterrupted access to any third-party integration.
9. AI-Assisted Features
ThankRank may provide AI-assisted replies, summaries, insights, reports, recommendations, and other generated content.
AI-generated output is provided to assist you and may be inaccurate, incomplete, outdated, misleading, or unsuitable for your particular circumstances.
You are responsible for reviewing and approving AI-generated content before publishing it, sending it to customers, or relying on it for business decisions.
You must not use AI-assisted features to generate unlawful content, mislead customers, impersonate individuals without authorization, or violate third-party rights or applicable laws.
We do not guarantee that AI-generated content will be unique, factually correct, legally compliant, or suitable for a particular business outcome.
AI visibility and search monitoring features, where available, provide observations or estimates based on the relevant tools and data. Results may vary by query, location, time, platform, and methodology. We do not guarantee rankings, mentions, recommendations, or visibility in any AI system or search engine.
10. Your Content and Data
You retain the rights you hold in content and information that you submit to ThankRank, subject to third-party rights and applicable law.
You grant ThankRank a limited, non-exclusive permission to host, process, reproduce, transmit, display, and otherwise use your submitted content as reasonably necessary to provide, maintain, secure, and support the services, carry out your instructions, and comply with applicable law.
This permission is limited to those purposes and does not transfer ownership of your content to ThankRank.
You represent that you have the rights, permissions, and lawful basis necessary to submit the content and authorize its processing for the intended use.
You are responsible for ensuring that information you upload or connect is accurate where accuracy is required, lawfully obtained, and appropriate for use through the service.

11. Intellectual Property
Except for content and materials owned by customers or other third parties, ThankRank and its licensors retain the rights they hold in the service, including its software, design, branding, website content, interfaces, and related materials.
Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the service for its intended business purposes.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the service except where expressly authorized by us or permitted by applicable law.
ThankRank names, logos, and branding may not be used in a way that suggests an affiliation, endorsement, or authorization that does not exist.
Third-party names, trademarks, and logos remain the property of their respective owners.
12. Service Availability and Changes
We aim to provide a useful and reliable service, but we do not guarantee that ThankRank will always be available, uninterrupted, error-free, or compatible with every device, platform, or configuration.
The service may occasionally be unavailable because of maintenance, updates, security issues, technical failures, third-party outages, or circumstances outside our reasonable control.
We may update, modify, add, restrict, or discontinue features as the service develops. Where a change materially affects a paid service, we will act in accordance with applicable law and any applicable contractual obligations.
We are not responsible for delays or interruptions caused by independent third-party services or circumstances beyond our reasonable control, except to the extent that applicable law provides otherwise.
13. Suspension and Termination
You may stop using ThankRank at any time and cancel your subscription according to Section 5.
We may suspend or terminate your access, restrict particular features, or take other reasonable protective measures if:
You materially violate these Terms.
Your use creates a security risk or threatens the service or other users.
We reasonably suspect fraud, unauthorized access, or unlawful activity.
Payment remains overdue, subject to applicable billing terms and law.
A third-party platform or legal requirement prevents us from continuing to provide a relevant feature.
We are legally required to do so.
Where reasonably practicable and legally permitted, we may provide notice and an opportunity to address the issue before taking action. Immediate action may be necessary for security, legal compliance, or serious misuse.
If we discontinue the service or terminate a paid subscription for reasons unrelated to your breach, any refund or other remedy will be handled in accordance with applicable law and the circumstances of the termination.
After termination, your right to access paid features ends, subject to any remaining subscription period or other rights that apply. Provisions that by their nature should continue, including those concerning intellectual property, outstanding fees, liability, disputes, and lawful retention of information, will survive termination.
14. Disclaimers
To the maximum extent permitted by applicable law, ThankRank is provided on an “as available” basis.
We do not guarantee any particular business result, increase in reviews, improvement in ratings, increase in customer engagement, search ranking, revenue, lead generation, or AI visibility.
Results depend on many factors outside our control, including customer behavior, business operations, platform policies, competition, location, and third-party algorithms.
Information and insights provided by the service are for general business use and do not constitute legal, financial, or other professional advice.
Nothing in these Terms excludes a warranty, statutory right, or consumer protection that cannot lawfully be excluded.
15. Limitation of Liability
To the maximum extent permitted by applicable law, ThankRank will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, business opportunities, goodwill, anticipated savings, or data arising from or related to your use of the service.
To the maximum extent permitted by applicable law, ThankRank’s total aggregate liability for claims arising out of or relating to the service or these Terms will be limited to the amount you paid to ThankRank for the service during the three months immediately preceding the event giving rise to the claim.
If you use a free plan and have not paid fees during that period, the limitation will apply to the extent permitted by applicable law.
These limitations do not apply to liability that cannot lawfully be limited or excluded, including any liability that applicable law expressly requires to remain available.
Nothing in this section removes rights or remedies that applicable consumer protection law makes mandatory.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and reasonable expenses arising from your unlawful use of ThankRank, your material violation of these Terms, or your infringement of another person’s rights.
This section does not require you to indemnify ThankRank for losses caused by our own unlawful conduct or liability that cannot lawfully be transferred to you.
17. Privacy
Your use of ThankRank is also subject to our Privacy Policy, which explains how personal information may be collected, used, disclosed, and retained.
By using the service, you acknowledge that you have had the opportunity to review the Privacy Policy. Where consent is legally required, it will be obtained separately.
You are responsible for ensuring that your use of ThankRank and any personal information you submit or process through the service complies with the privacy laws applicable to your business and customers.
18. Changes to These Terms
We may update these Terms to reflect changes to ThankRank, our services, business practices, or legal requirements.
When we make changes, we will update the “Last updated” date at the top of this page. Where required by law, we will provide notice of material changes or obtain consent before they take effect.
Your continued use of the service after updated Terms take effect indicates acceptance where such acceptance is legally effective. If you do not agree to a material change, you should stop using the affected service and cancel any subscription as appropriate.
Changes will not remove rights that applicable law requires us to preserve.
19. Governing Law and Disputes
These Terms are governed by the laws of India, subject to any mandatory laws that apply to you and cannot lawfully be excluded.
Any dispute arising from these Terms or your use of ThankRank will be addressed through the dispute-resolution procedures available under applicable law.
Nothing in this section prevents a consumer from exercising a right to bring a claim before a court, tribunal, regulator, or other authority where applicable law permits or requires it.
20. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise. We may transfer our rights and obligations as part of a lawful business transfer or service reorganization, subject to applicable law.
These Terms, together with any applicable plan terms and the Privacy Policy, govern your use of ThankRank. If a specific written agreement signed by us conflicts with these Terms, that agreement will control to the extent of the conflict.
